These Terms and Conditions ("Terms") govern your access to and use of the MoneyMaster platform ("Platform"), operated by POLARBIT SOLUTIONS LIMITED (Incorporation No. BC1547199), operating under the trade name POLARBIT, a company incorporated under the laws of British Columbia, Canada, with its registered office at 700-838 W Hastings Street, Vancouver, British Columbia, Canada, V6C 0A6 ("Company", "we", "us", "our"). The Company is registered with the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC) as a Money Services Business (MSB Registration No. M23258953). By accessing or using our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately cease using the Platform.
You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is higher) to use our services. By using MoneyMaster, you represent and warrant that: (a) you meet the applicable age requirement; (b) you have the legal capacity to enter into a binding agreement; (c) you are not a resident or national of any jurisdiction where our services are prohibited; (d) you are not on any sanctions list maintained by Canada, the United States, the European Union, or the United Nations; (e) you will not use the Platform from any sanctioned jurisdiction; and (f) your use of the Platform complies with all applicable laws and regulations in your jurisdiction.
To use our services, you must create an account with accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use. As a FINTRAC-registered MSB, we are required to verify your identity before processing transactions. You agree to provide all requested identification documents and information for Know Your Customer (KYC) and Anti-Money Laundering (AML) verification purposes. We reserve the right to refuse service, suspend, or terminate your account at any time if verification cannot be completed to our satisfaction.
MoneyMaster provides a platform that facilitates the exchange between fiat currencies and cryptocurrencies. IMPORTANT: The Company acts solely as an intermediary and facilitator of transactions. The Company is NOT a bank, financial institution, custodian, fiduciary, investment advisor, broker-dealer, or exchange. The Company does not hold, store, or custody user funds beyond the time necessary to process a transaction. Our services include Wire-to-Crypto transfers, Crypto-to-Wire transfers, and Card-to-Crypto purchases. All transactions are subject to verification, compliance review, and applicable fees. The Company reserves the right to decline, delay, suspend, freeze, or reverse any transaction at its sole and absolute discretion, without obligation to provide reasons.
All applicable fees and exchange rates are disclosed at the time of each transaction before you confirm your order. Rates are indicative and subject to change; the final rate applied is the rate at the time of transaction processing, which may differ from the quoted rate. We reserve the right to modify our fee structure at any time. Transaction processing times are estimates only and the Company makes no guarantee regarding the timing of any transaction completion. Delays may occur due to compliance reviews, network congestion, banking partner processing times, or other factors beyond our control.
BY USING THIS PLATFORM, YOU ACKNOWLEDGE AND ACCEPT THE FOLLOWING RISKS: (a) Cryptocurrency values are highly volatile and can decrease significantly in value, including to zero; (b) Blockchain transactions are irreversible once confirmed; (c) You may lose part or all of the value of any funds involved in a transaction; (d) Regulatory changes may adversely affect the value, transferability, or legality of cryptocurrency; (e) Technology failures, hacking, or cybersecurity incidents may result in loss of funds; (f) Wire transfers and banking operations are subject to banking partner policies and may be delayed, reversed, or frozen; (g) The Company does not guarantee the success, timing, or completion of any transaction; (h) Registration with FINTRAC does not constitute an endorsement, guarantee, or insurance of our services by any government body.
By using our Platform, you represent, warrant, and covenant that: (a) All funds used in transactions are derived from legitimate and lawful sources; (b) You are the rightful owner of all funds and payment methods used; (c) No funds are derived from, connected to, or associated with any criminal activity, money laundering, terrorism financing, tax evasion, fraud, sanctions evasion, or any other unlawful activity; (d) No funds are stolen, fraudulently obtained, or subject to any third-party claims; (e) You are not conducting transactions on behalf of any sanctioned individual, entity, or jurisdiction; (f) You will not use the Platform to circumvent any applicable laws, regulations, or sanctions. Any violation of these representations may result in immediate account termination, transaction reversal, fund withholding, and reporting to relevant law enforcement and regulatory authorities.
The Company reserves the absolute right, at its sole discretion and without prior notice, to: (a) Withhold, freeze, delay, or suspend any transaction or funds for any reason, including but not limited to compliance review, suspicious activity investigation, regulatory requirements, or risk management; (b) Report any suspicious transactions or activities to FINTRAC, law enforcement, or other relevant authorities as required by the Proceeds of Crime (Money Laundering) and Terrorist Financing Act (PCMLTFA) and associated regulations; (c) Require additional documentation, verification, or information before releasing any funds; (d) Permanently retain funds that are determined to be connected to illegal activity or that cannot be verified to the Company's satisfaction; (e) Deduct any amounts owed to the Company, including fees, penalties, or damages, from funds held on behalf of the user. You acknowledge and agree that the Company shall have no liability whatsoever for exercising any of these rights.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: (a) THE COMPANY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF FUNDS, BUSINESS INTERRUPTION, OR ANY OTHER COMMERCIAL DAMAGES OR LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF OR INABILITY TO USE THE PLATFORM; (b) The Company assumes NO responsibility or liability for any funds that are frozen, seized, delayed, lost, stuck, or otherwise made unavailable by banks, financial institutions, payment processors, blockchain networks, regulatory authorities, or any third party; (c) The Company assumes NO responsibility for any errors in wallet addresses, bank details, or other information provided by users; (d) The Company is NOT liable for any losses arising from unauthorized access to your account; (e) The Company's total aggregate liability for any and all claims shall not exceed the fees actually received by the Company from you for the specific transaction giving rise to the claim; (f) The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
You agree to indemnify, defend, and hold harmless Polarbit Solutions Limited, its directors, officers, employees, agents, partners, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable legal fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any rights of a third party; (e) any claim that funds used by you in a transaction were derived from unlawful sources; or (f) any dispute between you and a third party regarding a transaction processed through the Platform.
The Company does not guarantee that the Platform will be available at all times or without interruption. The Company may suspend, restrict, or terminate access to the Platform at any time, for any reason, including but not limited to: maintenance, upgrades, regulatory requirements, compliance concerns, or business decisions. The Company shall have no liability for any downtime, service interruptions, or termination of access.
All content, trademarks, logos, software, and intellectual property displayed on MoneyMaster are owned by Polarbit Solutions Limited or its licensors. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from or relating to these Terms or your use of the Platform shall be resolved exclusively by the courts of British Columbia, Canada, and you hereby irrevocably consent to the jurisdiction of such courts. You agree to waive any objection based on lack of personal jurisdiction, place of residence, improper venue, or forum non conveniens.
The Company reserves the right to modify, amend, or update these Terms at any time without prior notice. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
These Terms, together with our Privacy Policy and all other policies referenced herein, constitute the entire agreement between you and Polarbit Solutions Limited regarding your use of the Platform and supersede all prior agreements, negotiations, and understandings.
